The Deputy Senate President, Senator Ike Ekweremadu Tuesday raised the alarm that the pending forgery case against him would not be treated fairly because, ”the judge handling the case is a close friend of the national leader of the All Progressives Congress, APC, Asiwaju Bola Ahmed Tinubu.
The deputy Senate president is standing trial before a Federal High Court sitting Abuja for allegedly forging the Senate standing orders that was used for the controversial June 9, 2015 election of presiding officers for the Senate.
Senator Ekweremadu was dragged to court last year by five APC senators led by Senator Abu Ibrahim.
But in a letter he personally wrote to the Chief Judge, Federal High Court and copied to the Chief Justice of the Nigeria, Ekweremadu claimed he cannot get fair hearing from the trial judge, Justice Adeniyi Ademola.
”I’m a member of the Peoples Democratic Party (PDP) and the above suit is one by which the plaintiff who are members of the All Progressives Congress (APC), seek to remove me as Deputy Senate President. The matter is highly sensitive political matter and should be heard and determined by judicial officer who is totally independent, unbiased and has no link with any political party or political affiliation.
”Since the above suit was filed my counsel has been subjected to various act of intimidation and harassment by Honourable Justice Ademola and any independent bystander in court cannot but arrive at the conclusion that Justice Ademola is clearly biased in this matter and he is working to a predetermined conclusion”, he said.
Deputy Senate President Ekweremadu further claimed that he was in possession of strong evidence linking the judge to the APC and its top leadership.
”I have incontrovertible evidence that he is a very close friend of Chief Bola Tinubu, the leader of APC. Justice Ademola’s wife, Mrs. Olabowale Toluwalope Ademola was on October 19th, 2015 sworn in as the Head of Service in Lagos State, a state under the control of APC and a position which is held at the pleasure of the APC Governor of Lagos.
”My lord, in the circumstances, there is real likelihood of bias on the part of Justice Ademola and I do not have confidence in His lordship, Justice Ademola to do impartial justice in this case. I hereby apply for the transfer of the suit in accordance with Order 49 Rule 2 of the Federal High Court Rules”, Ekweremadu pled.
